Treaty eligibility applies
This category is only available to nationals of countries that maintain a qualifying treaty with the United States. Treaty lists change, so we do not reproduce one here — check your nationality against the official list before making any plans or commitments.
Visa overview
The E-1 is for nationals of treaty countries who come to the United States to carry on substantial international trade, principally between the United States and their country of nationality. Trade means the international exchange of qualifying items — goods, services, technology, banking, insurance, transport and more. Two tests define the category: the trade must be substantial, meaning a continuous flow of numerous transactions over time rather than one large deal, and it must be principally between the two treaty countries, conventionally understood as more than half of the enterprise’s total international trade.
Who may qualify
- Nationals of a country maintaining a qualifying treaty of commerce with the United States
- Traders whose enterprise carries on a continuous flow of substantial international trade
- Enterprises where more than half of the total international trade is between the US and the treaty country
- Essential employees sharing the treaty nationality in supervisory, executive or highly specialised roles
This is general information about the category, not an assessment of your circumstances.
Key requirements
- A qualifying treaty nationality — verify against the official Department of State list
- Existing trade already under way, evidenced by completed transactions
- Trade that is substantial in volume and continuity, not a single transaction
- More than half of the enterprise’s international trade conducted between the two treaty countries
- A role that is genuinely executive, supervisory or essential to the enterprise
Typical application process
- Verify treaty nationality and confirm the ownership structure of the enterprise
- Compile the trade record: invoices, bills of lading, contracts and customs documentation
- Analyse the trade to demonstrate both substantiality and the principal-trade proportion
- Prepare evidence of your role within the enterprise
- Apply at the consular post handling E-visa cases for your country
- Attend the interview prepared to discuss the trade record in detail
Documents commonly required
- Passport evidencing the treaty nationality
- Ownership documents showing the nationality of the enterprise
- Invoices, contracts, bills of lading and customs records covering the trade period
- A summary analysis of trade volume by country, with underlying records
- Financial statements and tax filings for the enterprise
- Evidence of your position and duties within the enterprise
Typical processing considerations
E-1 cases are handled by designated consular posts whose procedures and appointment availability vary by country. The evidentiary burden falls on demonstrating the trade record, so the time required depends largely on how well transaction documentation has been maintained. No date or outcome can be guaranteed.
